Freedom of Speech at Mt. SAC

Recommended Public Forum Spaces  are "areas generally available to students and the community" (AP 3900).  In order to ensure safety of the campus, use of areas generally available to students and the community require a reservation for campus members through 25Live for students, faculty, and staff only.  Campus visitors are encouraged to visit the Student Life Center to receive information about Campus Policies and Procedures and to fill out a Check-In Form for Use of Free Speech Form that provides emergency contact information .  Request forms are completed in the Student Center, Building 410.  A Student Life Staff member will sign the request and provide you with a copy.   The Department of Police and Campus Safety Officer, a Student Life staff member, and campus employees encourage campus visitors to complete the check-in process.   Although you are encouraged to complete the request form at least one week in advance, you may complete the form on the day you intend to use the Public Forum Space.   Forms are not available online.

DISTRICT REGULATIONS

In order to provide an atmosphere in which groups and organizations can function without disrupting the College’s curricular programs, the Governing Board places the following restrictions on the time, place and manner of non-curricular activities at Mt. San Antonio College (CA Ed. Code 48907 sec. b, CA Ed. Code 76120 & AP 3900).

 Therefore, per district policies no person shall:

  • Impede the progress of passersby
  • Force passersbys to take material
  • Interfere with, impair or impede with the flow of vehicular or pedestrian traffic, classes, events or normal and essential college operations
  • Use amplified sound or music of any type
  • Solicit donations of money, through direct requests for funds, sales, or otherwise
  • Solicit or provide information for the purpose of requests for funds, sales, or otherwise

EDUCATION CODE

As per the California Education Code Section 48907:

(b) The governing board or body of each school district or charter school and each county board of education shall adopt rules and regulations in the form of a written publications code, which shall include reasonable provisions for the time, place, and manner of conducting such activities within its respective jurisdiction.

The College has set policies by which all members of the public shall abide by while on campus. See below for specific provisions.

STATE LAW

The California Education code is state law. Per the California Education Code Section 76120:

76120.  The governing board of a community college district shall adopt rules and regulations relating to the exercise of free expression … upon the premises of each community college maintained by the district, which shall include reasonable provisions for the time, place, and manner of conducting such activities … except that expression which … incites students as to create a clear and present danger of the commission of unlawful acts on community college premises, or the violation of lawful community college regulations, or the substantial disruption of the orderly operation of the community college, shall be prohibited.
